ADMINISTRATIVE — [REDACTED], Confidential Investigative Unit, New York State Crime Commission.
On 11/6/58, [REDACTED] advised that an investigator for the Confidential Investigative Unit of the NYS Crime Commission had served a subpoena on the subject in Niagara Falls, NY, calling for his appearance before the NYS Crime Commission in NYC on 11/7/58. The informant said investigators tried unsuccessfully for several days to serve the subpoena. It was necessary for them to stake out the subject's home, but apparently he did not return home at night. The informant noted that investigators determined the subject's polling location for Election Day, 11/4/58, waited there, and served the subpoena as he came to vote. According to the informant, when served, the subject threw the subpoena on the ground, said, “Didn't do anything,” and it was retrieved by an investigator and handed back to him.
The informant further advised the appearance before the NYS Crime Commission in NYC was postponed because the subject's attorney was tied up in court on another matter; no definite appearance date had been set.
